This Legal Update reports on significant changes to the local rules and procedures for all US federal district and appellate courts between Feburary 13 and 19, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

Second Circuit

District of Connecticut

The court posted a new civil cover sheet.

Eastern District of New York

The court updated its CM/ECF User Manual, adding steps for e-filing sealed documents in civil and criminal cases.

Southern District of New York

Judge Katherine B. Forrest posted a new Civil Case Management Plan and Scheduling Order.
Magistrate Judge Gabriel W. Gorenstein posted a new Settlement Conference Acknowledgment Form.

District of Vermont

The court announced a proposed amendment to Local Rule 83.2 governing courthouse security and the use of electronic devices in court. The comment period ends March 18, 2013 and the changes adopted by the court have an expected effective date of April 1, 2013. The specific changes can be seen in the redline version of the rules.

Third Circuit

Western District of Pennsylvania

The court posted a new standing order on electronic devices brought into the courthouse.

District of the Virgin Islands

The court posted a general order regarding fee payment via Pay.gov. Effective March 1, 2013, all electronic case filers must use the Pay.gov internet payment module in CM/ECF. The court also posted guidance on the implementation of the Pay.gov internet payment process.

Fifth Circuit

Seventh Circuit

Southern District of Illinois

Chief Judge David R. Herndon updated his case management procedures. Submissions to chambers must now be in Word format, not WordPerfect. The changes can be seen in the redline of the procedures.

Northern District of Indiana

The court changed the following fees in its fee schedule:
  • For a duplicate certificate of admission: $18 (previously $15).
  • For exemplification of any document or paper: $21 (previously $18).

Ninth Circuit

District of Arizona

The court posted redaction techniques for e-filing.

Central District of California

The court announced proposed amendments to the Local Civil and Local Criminal Rules. The amended rules include:
    • 4-4, concerning service of process in habeas corpus proceedings;
    • 5-3, concerning service of documents;
    • 5-4, concerning filing of documents;
    • 7-3, concerning conference of counsel prior to filing of motions;
    • 54-2, concerning the application to tax costs pursuant to FRCP 54(d) and bill of costs;
    • 54-11, concerning the filing date for motions to award costs not governed by FRCP 54(d);
    • 83-2, concerning attorneys and parties without attorneys; and
    • 83-4, concerning student practice.
  • Local Criminal Rule 46-1.2, concerning bail previously fixed by the district judge.
All comments to the court must be submitted no later than March 18, 2013. The proposed effective date for these amended rules is June 1, 2013.

Tenth Circuit

Tenth Circuit Court of Appeals

The Tenth Circuit posted an updated briefing and appendix checklist. The checklist includes all the requirements (in both the Federal Rules of Appellate Procedure and 10th Circuit local rules) for filing a primary brief.
