This Legal Update reports on significant changes to the local rules and procedures for all US federal district and appellate courts between July 3 and July 9, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

District Court for the District of Columbia

Second Circuit

Eastern and Southern Districts of New York

The US District Courts for the Eastern and Southern Districts of New York have updated their local rules. The new rules include amendments to Local Rule 54.1.

Fourth Circuit

Western District of Virginia

The US District Court for the Western District of Virginia posted a standing order regarding the division of cases among district judges.

Fifth Circuit

Southern District of Texas

The US District Court for the Southern District of Texas posted an order amending its jury plan.

Eighth Circuit

Western District of Missouri

The US District Court for the Western District of Missouri has posted a notice regarding revisions to Local Rule 16.5, as well as a redline of the changes. The new rule will go into effect on August 1, 2013.

Ninth Circuit

Central District of California

The US District Court for the Central District of California began a pilot project for the electronic submission and filing of under seal documents on July 8.
In light of the pilot project, several judges have updated their rules:
  • Magistrate Judge Jacqueline Chooljian added the following to her procedures:
    "Under Seal Documents - Counsel/parties are directed to deliver to Civil Intake, one copy of the application, proposed order and document requested to be filed under seal, no later than 12 noon on the next business day after the documents are electronically filed, pursuant to Local Rule 5-4.5."
  • Judge R. Gary Klausner posted instructions regarding filing under seal.
  • Judge Beverly Reid O'Connell posted instructions regarding filing under seal.
  • Magistrate Judge Suzanne H. Segal added the following to her procedures:
    "Under Seal Documents - Counsel/parties are directed to deliver to Civil Intake, one copy of the application, proposed order and document to be filed under seal, no later than 12 noon on the next business day after the documents are electronically filed, pursuant to Local Rule 5-4.5. Documents should also be emailed to [email protected]."
  • Magistrate Judge Patrick J. Walsh added the following to his procedures:
    "Under Seal Documents - Counsel/parties are directed to deliver to Civil Intake, one copy of the application, proposed order and document to be filed under seal, no later than 12 noon on the next business day after the documents are electronically filed, pursuant to Local Rule 5-4.5."
  • Judge Dolly M. Gee updated paragraph 19 of her procedures regarding filing under seal.
  • Judge Margaret M. Morrow updated paragraphs 1 and 2 of her procedures regarding filing under seal. She also added new guidance regarding filing under seal.
  • Judge James V. Selna updated paragraph 17 of his procedures regarding filing under seal.
The following Central District of California judges made other changes to their rules and procedures:
  • Judge Beverly Reid O'Connell updated her Order Setting Scheduling Conference. The previous version of her order is available here. Judge O'Connell also added the following to her procedures:
    "If counsel has received a 'Notice to parties of Court-Directed ADR Program' (form ADR-08), the Court will presumptively refer the case to the Court Mediation Panel or to a private mediation at the time of the initial scheduling conference. See general Order 11-10, 5.1. Counsel are directed to furnish and discuss this Notice with their clients in preparation for the parties' Fed.R.Civ.P. 26(f) conference. Counsel should include their shared or separate views regarding a preference for the Court Mediation Panel or private mediation, and when the mediation should occur, in the written report required by Fed.R.Civ.P 26(f) and Civil L.R. 26-1. For information about the Court's ADR program, please see General Order 11.10, which is located in the 'General Orders' section on the home page and in the 'ADR' page on the Court's website."
  • Magistrate Judge Sheila K. Oberto added a set of rules regarding Trial Conduct and Courtroom Decorum.
  • Judge Otis D. Wright II updated his Scheduling and Case Management Order. The previous version of this order is available here. Judge Wright also posted a Scheduling and Case Management Order for bench trials.
