Standard clauses to be inserted into a commercial agreement to give parties the opportunity to resolve disputes through mediation, or mediation and arbitration (med-arb) before litigation or arbitration is commenced. Guidance is provided on using the clause under the laws of China. If any parties are foreign (that is, not Chinese), use Standard Clause, Mediation: China instead.

These clauses are based on the model clauses provided by the China Council for the Promotion of International Trade (CCPIT) (also known as the China Chamber of International Commerce (CCOIC)) Mediation Centre, which is affiliated with the China International Economic and Trade Arbitration Commission (CIETAC).
