In Mr Tza Yap Shum v Peru (ICSID Case No. ARB/07/6) (Annulment Proceeding), an ICSID ad hoc committee considered Peru’s request for partial annulment of a decision on jurisdiction and competence due in part to the tribunal’s approach to interpreting the dispute resolution provisions of the Peru-China bilateral investment treaty (BIT).
