Braun v First Secretary of State, 20 May 2003 (Court of Appeal).
The Court of Appeal has confirmed that breaches of listed building control can be enforced against an owner, no matter when or by whom the breaches were committed. If, however, a planning authority is seeking to enforce all contravening works back to the date of listing, this must be made very clear from the face of the enforcement notice.
