Trademark Trial and Appeal Board (TTAB)

An administrative board within the US Patent and Trademark Office (USPTO) responsible for hearing and ruling on certain disputes relating to federal trademark registrations and applications for registration, primarily:
  • Appeals by trademark applicants from a USPTO trademark examining attorney's final refusal to register a trademark.
  • Opposition proceedings filed by a party objecting to another party's trademark application prior to registration.
  • Cancellation proceedings filed by a party seeking to revoke another party's registered trademark.
  • Concurrent use proceedings, which involve determining whether an applicant is entitled to a concurrent trademark registration (a registration with certain limitations, usually related to geographic scope of use or the type of goods or services offered under the trademark when an unrelated party already registered, or applied for registration of, the same or a confusingly similar trademark).
TTAB decisions may be appealed to a US district court or the US Court of Appeals for the Federal Circuit.
