Broom Clean Condition

The condition in which real property may be delivered under the negotiated terms of either a purchase agreement or lease agreement. Generally, the real property is broom swept clean with all the personal property removed.
In the context of a real property sale, the seller delivers the real property to the purchaser in a broom clean condition on the date when the title passes to the purchaser. This is a common negotiated standard in a residential purchase agreement but is not typical in a commercial context, where the usual standard is as-is.
In a lease agreement, the leased premises are typically required to be delivered in a broom clean condition by the:
  • Landlord to the tenant on the commencement date.
  • Tenant to the landlord on the expiration date.
