The final version of the CRC Energy Efficiency Scheme (Amendment) Order 2011 was laid before Parliament, the Scottish Parliament, the National Assembly for Wales and the Northern Ireland Assembly on 16 February 2011. In addition, the government published its response to the November 2010 consultation on 15 February 2011.
On 16 February 2011, the final version of the CRC Energy Efficiency Scheme (Amendment) Order 2011 (2011/234) was published and was laid before Parliament, the Scottish Parliament, the National Assembly for Wales and the Northern Ireland Assembly, together with an explanatory memorandum.
The final version of the Amendment Order is in substantially the same form as the draft version published on 17 November 2010 as part of the consultation on the proposed amendments (for further details, see Legal update, CRC: consultation on amendments to the CRC Energy Efficiency Scheme (Corporate aspects)). The government's response to the consultation was published on 15 February 2011.
As proposed, the changes made to the CRC Energy Efficiency Scheme Order 2010 (SI 2010/768) by the Amendment Order include:
  • Extending the introductory phase of the scheme to run until the end of March 2014 (rather than the end of March 2013) and postponing the start of each of the second and subsequent phases by two years (see CRC Energy Efficiency Scheme: PLC timeline).
  • Removing the requirement for organisations which are not required to register as participants to make "information disclosures".

The Amendment Order comes into force on 1 April 2011. The government is currently consulting on how the scheme can be further simplified in phase 2 (see Legal update, CRC: DECC publishes five discussion papers on simplifying the scheme).
