Model State Anticounterfeiting Bill

A model statute published in 2006 by the International Trademark Association (INTA) in consultation with the International AntiCounterfeiting Coalition (IACC) for use by states in developing or updating their trademark anti-counterfeiting laws. Significant provisions of the model bill include:
  • Alignment of state criminal counterfeiting penalties with federal standards.
  • Enhanced criminal penalties where the offender causes or attempts to cause serious bodily injury or death.
  • Mandatory destruction, forfeiture, and restitution.
The bill is based in part on a previous model developed by the IACC in 1995 that more than one-third of the states have enacted in some form. For more information, including the text of the model bill, see the INTA website.
