In Dar Al Arkan Real Estate Development Company and another v Majid Al-Sayed Bader Hashim Al Refai and others [2012] EWHC 3539 (Comm), the High Court considered whether the claimants had complied with their obligation of full and frank disclosure on a without notice application, a subsequent order and an undertaking to the court. The court then decided whether to set aside the orders obtained.
