The Department of Labor (DOL) announced a new online tool, the iCERT Labor Certification Registry, that will provide the public with real-time access to redacted documents in the H-1B, H-1B1, E-3, H-2A, H-2B and permanent labor certification (PERM) employment-based immigration programs beginning July 1, 2013.
On January 23, 2013, the DOL issued a notice announcing a new online tool, the iCERT Labor Certification Registry (LCR), that will provide the public with real-time access to:
  • Redacted documents in the H-1B, H-1B1, E-3, H-2A, H-2B and permanent labor certification (PERM) employment-based immigration programs, including labor certification and Labor Condition Application (LCA) documents.
  • The latest quarterly and annual case disclosure data for the Office of Foreign Labor Certification.
Public access to the iCERT LCR will be available through the iCERT Visa Portal System beginning July 1, 2013.
Although private, sensitive or legally protected information will be redacted, documents will include:
  • The employer's Federal Employer Identification Number (EIN).
  • The employer's reported revenue.
  • The foreign worker's name, address and class of admission.
The new system marks a change from previous practice, where access to these documents typically was provided in response to a Freedom of Information Act request and was never granted in real time.
When launched, the iCERT LCR will include all labor certification documents within two business days after an official decision is rendered on the LCA or PERM application. Documents issued on or after April 15, 2009 will also be available on the registry.
