On March 24, 2014, the US Supreme Court denied certiorari in Delaware Coalition for Open Government v. Strine, the case brought against the State of Delaware's proposed confidential judicial-arbitration procedures (No. 13-869, (U.S. Mar. 24, 2014)). The Supreme Court's order means that the arbitration program remains unconstitutional according to the Third Circuit's ruling, which found that the judicial-arbitration procedures violated the First Amendment's right of access.
