The US Patent and Trademark Office (USPTO) proposed reduced fees for certain trademark application and renewal fees filed online.
The USPTO issued a notice of proposed rulemaking announcing proposed reductions for trademark applications and renewal fees for applications and renewals filed online (79 Fed. Reg. 26664-01 (May 9, 2014)). The fees for filing applications and renewals on paper would remain unchanged. The proposals aim to further USPTO objectives to increase efficiency.
Specifically, the USPTO proposes to amend the Trademark Rules of Practice to reduce filing fees from:
  • $325 to $275 per class for filing trademark, service mark, certification mark, collective membership mark and collective trademark applications for registration on the Principal or Supplemental Register under Section 1 or Section 44 of the Lanham Act filed through the Trademark Electronic Application System (TEAS), if applicants authorize e-mail communication and agree to file documents electronically throughout the prosecution process. This will be known as a TEAS Reduced Fee (TEAS RF) application.
  • $275 to $225 per class for a TEAS Plus application.
  • $400 to $300 per class for a TEAS application for renewal of a registration.
TEAS Plus and TEAS RF applicants who fail to fulfill the proposed rules' requirements will be subject to a $50 processing fee per class.
Interested parties may submit comments 45 days after publication of the proposed amendments in the Federal Register.
