In Diag Human Se v Czech Republic [2014] EWHC 1639 (Comm), the court considered whether to refuse enforcement of a New York Convention award on grounds of either issue estoppel, or that the award was not binding under section 103(2)(f) of the Arbitration Act 1996 as it was subject to "ordinary recourse".
