This wage and hour Law Firm Publication by Jackson Lewis P.C. discusses a recent Virginia Executive Order calling for interagency cooperation and enforcement concerning the misclassification of workers. On August 14, 2014, Governor Terry McAuliffe signed the Executive Order, effective immediately, establishing an interagency task force on worker misclassification and payroll fraud. The Order makes official the Joint Legislative Audit and Review Commission's recommendation that state enforcement agencies combine their efforts to enforce misclassification laws and to remedy the negative impact that misclassification has on Virginia's state income tax collections. The task force will evaluate the agencies' enforcement practices, develop procedures for more effective cooperation and joint enforcement and make recommendations for legislative or administrative reform. A report on the progress of the task force will be provided to Governor McAuliffe by December 1, 2014.
