A Practice Note providing an overview of enforcement proceedings under the Martin Act, New York's Blue Sky law, or securities statute (N.Y. Gen. Bus. Law Article 23-A). Specifically, this Note reviews the elements of a Martin Act violation and the powers conferred on the New York Attorney General under the Martin Act, including the ability to conduct investigations, civil enforcement actions, and criminal prosecutions with respect to the offer and sale of securities and commodities.
