This Law Firm Publication by Jackson Lewis P.C. discusses a new version of Alabama's non-compete statute (Section 8-1-1 of the Code of Alabama), recently signed by Governor Bentley. The revised version of the statute provides six exceptions to the general ban on non-competes and provides time periods that state a presumption of reasonableness. The revised statute also continues to allow for blue pencilling. Finally, it explains "protectable interest" and makes changes the burden of proof as to undue hardship. The revised statute will become effective January 1, 2016.
