This retainer letter is suitable for a party appointed expert who will be providing advice or acting as an expert witness. It is not written with a single joint expert in mind and would need to be adapted for that purpose.
The letter sets out the terms which will govern the relationship between the instructing solicitors and the expert. It should be read in conjunction with the integrated drafting notes.
The retainer letter covers confidentiality, the effect of disclosing inside information under the Market Abuse Directive (where relevant), responsibility for work, conflicts of interest, fees and termination of the retainer.
The instructions are set out in Standard document, Experts: letter of instruction with the aim of retaining, as far as possible, any privilege in this retainer letter and avoiding having to disclose it. The retainer letter and the letter of instruction can be combined if you prefer.
