Pension scheme booklet does not override trust deed | Practical Law

In Steria Limited and others v Hutchison and others, the Court of Appeal reversed a decision of the High Court which had held that representations given to a member of a pension scheme created a binding estoppel. Mr Hutchison had received material from his employer that indicated he had a right to retire with a full pension at age 62, instead of 65. He claimed this created a binding estoppel that the trustees could not renege on. The Pensions Ombudsman had upheld his claim, as had the High Court at first instance.
