By virtue of section 105 of the Employment Rights Act 1996, the Maternity and Parental Leave etc Regulations 1999 (SI 1999/3312) and certain other statutory provisions, selecting an employee for redundancy on several prescribed grounds will make their dismissal automatically unfair. This checklist sets out the circumstances in which their selection for redundancy will be automatically unfair.
