An outsourcing transaction can trigger the transfer of an economic entity under Directive 2001/23/EC on safeguarding employees' rights on transfers of undertakings, businesses or parts of businesses (Directive). This chapter aims to provide an overview of the Directive, against the context of examples of national implementing legislation.
