Five precedent statements of case include the following types of claim: actual and repudiatory breach of contract, contractual debt, misrepresentation, negligence or breach of duty and restitution (mistake or failure of consideration). These were all drafted in association with Herbert Smith Freehills LLP.
Two further suites of documents deal with claims in common law private nuisance and negligent misstatement. These resources can be used as a template for drafting pleadings for each of these claims.
A further suite of documents deals with claims for trade mark infringement and, in the alternative should the claim for trade mark infringement fail, passing off. These were drafted by Practical Law IP&IT in association with 11 South Square.
