This Law Firm Publication by Jackson Lewis LLP discusses the Nebraska Supreme Court's decision in Moyera v. Quality Pork Int'l, in which the court held that the Nebraska Workers' Compensation Act applies to undocumented aliens. Persuaded by decisions from other jurisdictions and public policy concerns, the court concluded that these workers are eligible for permanent total disability benefits for work-related injuries under Nebraska's Workers' Compensation Act. Courts in nine other states have similarly found undocumented aliens to be covered by state workers' compensation laws.
