On 20 August 2013, the First-tier Tribunal (Information Rights) ruled that documents subject to legal professional privilege should not be disclosed under the "affecting the course of justice" exception in regulation 12(5)(b) of the Environmental Information Regulations 2004 (SI 2004/3391).
