This Legal Update reports on significant changes to the local rules and procedures for all US federal district and appellate courts between October 23 and 29, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

Changes in Miscellaneous Fees

The Judicial Conference announced changes to the federal court miscellaneous fee schedules, effective December 1, 2013, as outlined below:
  • The fee for docketing a case in the US Court of Appeals will be increased from $455 to $505, which includes a $500 fee to docket the appeal and a $5 filing fee.
  • The records retrieval fee will be increased from $53 to $64 for the first box requested from a Federal Records Center and there will be a new fee of $39 for each additional box requested.
  • There will be a $53 fee for any payment returned or denied for insufficient funds.

Second Circuit

Southern District of New York

Judge Katherine B. Forrest updated her Individual Rules of Practice in Civil Cases. A copy of the previous version is available here.

Northern District of New York

The US District Court for the Northern District of New York announced a pilot mandatory mediation program beginning on January 1, 2014.
The Northern District of New York also amended General Order 25 regarding the expedited service of the summons and complaint and completion of Rule 16 Stipulations for the timely progression of civil actions.

Third Circuit

District of Delaware

Chief Magistrate Judge Mary Pat Thynge updated her Rule 16 Scheduling Order for Non-Patent Cases. A copy of the previous version is available here.

Fourth Circuit

Fourth Circuit Court of Appeals

The US Court of Appeals for the Fourth Circuit announced amendments to its local rules, effective December 1, 2013, to reflect the increase in the fee for docketing a case in the court of appeals. The Fourth Circuit provided a redline of the changes.
The Fourth Circuit also clarified the length requirements for reply briefs and amicus briefs in its Brief and Appendix Requirements chart.

Northern District of Ohio

The US District Court for the Northern District of Ohio updated its local rules. The new local rules include an amendment to Local Rule 3.13. A copy of the previous version is available here.

The US Court of Appeals for the Ninth Circuit updated its Manual of Model Civil Jury Instructions:
  • The following instructions were modified: 10.2B, 10.3.
  • The comments to the following instructions were modified: 5.6, 9.3, 9.9, 9.10, 10.4A.1, 12.6, 12.8, 17.18.
