Fourth Circuit: No Federal Jurisdiction Under Interstate Commerce Commission Termination Act Absent a Federal Tariff | Practical Law

In Gaines Motor Lines, Inc. v. Klaussner Furniture Industries, the US Court of Appeals for the Fourth Curcuit determined that a federal court lacked jurisdiction over motor carriers' breach of contract claims for unpaid freight charges in the absence of a federal tariff.  Accordingly, the case was remanded to the district court with instructions that it be dismissed.
