The FTC released revised FAQs updating the Commission's guidance on how the Children's Online Privacy Protection Act (COPPA) applies to schools and educational online services.
In April 2014, the FTC updated Complying with COPPA: Frequently Asked Questions, a Guide for Business and Parents and Small Entity Compliance. The FAQs provide informal guidance on how the Children's Online Privacy Protection Act (COPPA) regulations apply to schools and educational online services.
Some changes to the FAQs include:
  • Operators disclosing their data collection, use and sharing practices should use the direct notice requirements from the COPPA Rule.
  • Operators obtaining consent from schools on behalf of parents should meet the same high standard as verifiable parental consent.
  • When schools provide verifiable parental consent on behalf of parents, the FTC recommends that, as a best practice, schools and school districts, rather than individual teachers, should decide which online services are appropriate for the school.
  • When schools provide the required verifiable parental consent, the FTC recommends that, as a best practice, the school should consider providing parents with a notice of the websites and online services to which it has granted consent to collect their children's data.
