The US Copyright Office has announced the launch of the Fair Use Index, a searchable database of major fair use court decisions.
On April 28, 2015, the US Copyright Office announced it had launched the US Copyright Office Fair Use Index, a searchable database hosted on the Copyright Office's website that compiles summaries of major fair use decisions. The Copyright Office's goal is to make fair use principles and application more accessible and understandable to the public.
The index is searchable by court and category of work or type of use. The summaries include a brief overview of the facts, the relevant question presented and whether the court determined the contested use was fair. While the database includes each case's legal citation, it does not provide access to the actual opinion. The index also does not include every opinion on fair use.
The Copyright Office will periodically update and expand the database, which can be accessed here. For more information on copyright fair use, see Practice Note, Copyright Fair Use.
