Discretionary trust

A flexible trust under which no beneficiary of the trust has an automatic right to income or capital as it arises (and in which there is no interest in possession).
The trustees have the power to decide who (from a class of beneficiaries named in the trust document) should receive the capital or income from the trust.
Discretionary trusts are also relevant property trusts.
