Commission consults on draft revised Leniency Notice and ECN publishes model leniency programme | Practical Law
On 29 September 2006, the European Commission published for a consultation a draft Commission notice to replace the existing 2002 Leniency Notice. The draft notice includes new provisions relating to the information to be provided by a leniency applicant (including making a "corporate statement") and the Commission's procedures for handling applications. At the same time the European Competition Network (ECN) has published a model leniency programme setting a framework which ECN members have committed to try to follow in their national programmes. It provides for the provision of "summary applications" to national authorities where a full application for immunity has been made to the Commission.
