This case study illustrates an application to the English court for the determination of a jurisdictional issue, under section 72 of the Arbitration Act 1996 (AA 1996). Section 72 applies where the applicant has taken no part in the arbitration. It consists of an arbitration claim form and a witness statement, with accompanying drafting notes. The case study is illustrative only and is not intended to indicate whether or not a court would grant the order sought in the particular circumstances of the case.
