In Majrowski v Guy's and St Thomas' NHS Trust, the Court of Appeal allowed an appeal against a county court order striking out a statement of claim for damages against an employer under section 3 of the Protection from Harassment Act 1997. The decision is authority for the proposition that employers may be vicariously liable for breaches of statutory duties imposed on employees, as well as those imposed by common law.
