A note outlining the issues and rules applicable to contracts that are wholly or partially excluded from the Public Contracts Regulations 2006 (2006/05), such as contracts for Part B services, concession agreements and sub-threshold procurements.
With effect from 26 February 2015, the Public Contracts Regulations 2015 (2015/102)(PCR 2015) came into force. Subject to certain exceptions, the PCR 2015 applies to any contract award procedure commenced on or after 26 February 2015 and so replaces the Public Contracts Regulations 2006. Note also that on 18 April 2016, the Concessions Contracts Regulations 2016 (2016/273) came into force, providing a new regime for the award of concession contracts. This note therefore provides a useful resource to understand the rules and case law applicable to unregulated procurements under the old procurement regime, but for the reasons stated above is no longer maintained.
