Scope of this note

This toolkit contains resources designed to help in-house and law firm lawyers gain a basic understanding of various aspects of arbitrating in Asia, with an emphasis on arbitrating in China, Hong Kong, India, Indonesia, Japan, Singapore and South Korea.

 

Introduction

More and more companies are increasingly dependent on Asia to provide many of their manufacturing, personnel and other business needs. Although doing business in Asia has several benefits, companies should be prepared for potential commercial disputes with their Asian partners.

Parties to commercial transactions usually agree in advance to submit their disputes to binding arbitration ( www.practicallaw.com/4-107-6426) . Often, US and European companies choose to arbitrate commercial disputes before arbitral bodies located in the US or Europe. However, as Asian companies gain more leverage in the global market, companies may be forced by their Asian partners to agree to binding arbitration in Asia. Many US or European companies may have little or no experience arbitrating in Asia.
