In Pioneer Freight Futures Company Ltd v TMT Asia Ltd [2011] EWHC 1888 (Comm), the High Court has held that payment obligations that are suspended under section 2(a)(iii) of the 1992 ISDA Master Agreement should be taken into account for netting purposes under section 2(c).
