In MD (Afghanistan) v Secretary of State for the Home Department [2012] EWCA Civ 194, the Court of Appeal rejected an argument that it had jurisdiction to hear and determine an application for permission to appeal from judgments of the Administrative Court made on the papers under section 16(1) of the Senior Courts Act 1981.
