On August 13, 2012, final rules on the definitions of the terms "swap" and "security-based swap" were published in the Federal Register triggering many swap-related and certain other requirements under Title VII of the Dodd-Frank Act.
On August 13, 2012, final Dodd-Frank rules on the definitions of the terms "swap" and "security-based swap" (final definitional rules) were published in the Federal Register, triggering the effective dates for many Dodd-Frank swaps rules. The effective date for the final definitional rules and for certain key final Dodd-Frank swaps rules is October 12, 2012 (60 days after publication of the final definitional rules in the Federal Register, which occurred on August 13, 2012).
Rules that are effective on that date include registration requirements for swap dealers (SDs) and major swap participants (MSPs), as well as business conduct standards for SDs and MSPs and swap data reporting and recordkeeping obligations. Additionally, the application of the US securities laws to security-based swaps will become effective February 11, 2013 (180 days after publication of the final definitional rules in the Federal Register).

Title VII Rules Triggered

The publication of the final definitional rules in the Federal Register triggers the implementation dates of several final Title VII rules that have already been adopted. The following rules have been triggered:
