The FTC has released a report recommending best practices for companies using facial recognition technology.
On October 22, 2012, the FTC released a staff report, Facing Facts: Best Practices for Common Uses of Facial Recognition Technologies, a guide for companies using facial recognition technologies to protect consumers' privacy in their use of these technologies in commercial products and services.
Specifically, the staff report recommends that companies using facial recognition technology:
  • Design their services with consumer privacy in mind.
  • Develop reasonable security protections for collected facial recognition information and sound methods for determining when to keep or dispose of this information.
  • Consider the sensitivity of information when developing facial recognition products and services, including whether the product will be used in places where children congregate.
Although the report is not binding authority, it provides instruction regarding what the FTC may consider fraudulent, deceptive or unfair business practices in individual cases.
