In Olympic Airlines SA Pension and Life Assurance Scheme v Olympic Airlines SA [2013] EWCA Civ 643 (6 June 2013), the Court of Appeal held that a Greek company, already in Greek liquidation, did not have an establishment in the UK under Council Regulation (EC) 1346/2000 on insolvency proceedings and, accordingly, the court could not make a winding-up order over its UK operations.
