Ogletree Deakins: Oregon Legislature Votes to "Ban the Box" | Practical Law

This Law Firm Publication by Ogletree, Deakins, Nash, Smoak & Stewart, P.C. addresses Oregon Governor Kate Brown's expected signing of House Bill 3025 (HB 3025). This "ban the box" legislation would prohibit Oregon businesses from requiring applicants to disclose criminal convictions prior to an interview, including on employment applications. Employers would still be permitted to ask about criminal convictions during an interview or notify applicants of future required conviction disclosure or background checks. HB 3025 would not apply in certain situations where other laws require consideration of an applicant's criminal history such as for law enforcement positions. The law, enforced by the Oregon Bureau of Labor and Industries, would take effect on January 1, 2016.
