In St Helens Metropolitan Borough Council v Derbyshire & others the Court of Appeal overturned the decisions of the EAT and employment tribunal that employees bringing equal pay claims were victimised when the employer wrote to all staff informing them that the claims, if successful, would put everyone's jobs at risk. The matter has been remitted to the tribunal.
