Energy Charter Treaty (ECT)

A multilateral investment treaty that establishes a legal framework for energy trade, transit and investment between member states. Part III of the ECT contains substantive protections for investors, including the requirements of:
  • Most-favoured-nation treatment.
  • National treatment.
  • Fair and equitable treatment.
  • Protection from unreasonable or discriminatory measures.
  • Expropriation.
  • Compensation.
The ECT allows investors to file claims against ECT member states before international arbitration tribunals for violations of substantive ECT rights.
