This Note addresses a private employer's duty to provide a safe working environment under the Occupational Safety and Health Act (OSH Act), liability for workplace violence under workers' compensation law and negligence theories, granting medical leave to workplace violence victims, employment references for employees with known violent tendencies, and laws to consider when taking steps to minimize workplace violence, including the direct threat defense under the Americans with Disabilities Act (ADA).
