A Practice Note providing an overview of the US Patent and Trademark Office's (USPTO) rules of practice and trial practice guide for trials before the Patent Trial and Appeal Board (PTAB). On August 14, 2012, the USPTO issued a consolidated set of final rules, and a trial practice guide, governing trial practice for inter partes review, post-grant review, the transitional program for covered business method patents, and derivation proceedings. These rules took effect on September 16, 2012. The USPTO subsequently amended the rules, updated the trial practice guide, and incorporated the updates into the original August 2012 practice guide in a consolidated trial practice guide dated November 2019.
