An article covering the circumstances when a challenge to a recent or imminent procurement decision can be made by way of a claim for judicial review under Part 54 of the Civil Procedure Rules instead of a claim under the Public Contracts Regulations 2006 (SI 2006/5). Although the 2006 Regulations have been superseded by the Public Contracts Regulations 2015 (SI 2015/102), which regulations came into force on 26 February 2015, the cases and decisions under the previous regime are still relevant and of interest to a procurement specialist.
