In R (GSTS Pathology LLP and others) v Commissioners for Her Majesty's Revenue & Customs [2013] EWHC 1823 (Admin), the High Court held that it was in a good position, on the basis of the evidence provided, to form a view on the merits of the claim as if it was the final hearing of the judicial review and that the injunction sought by the claimant should be granted.
