This Legal Update reports on significant changes to the local rules and procedures for all US federal district and appellate courts between July 10 and July 16, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

Federal Circuit

Federal Circuit Court of Appeals

The US Court of Appeals for the Federal Circuit updated its CM/ECF User Guide. A copy of the previous guide is available here.

Second Circuit

Southern District of New York

The US District Court for the Southern District of New York announced revisions to its Electronic Case Filing Rules and Instructions, affecting Rules 4.3 and 9. The court issued an announcement detailing the revisions, which are effective July 19, 2013.

Third Circuit

District of Delaware

The US District Court for the District of Delaware has issued a standing order, Utilization of Magistrate Judges, clarifying that magistrate judges will be assigned individually to district court judges.

Eastern District of Pennsylvania

Newly-appointed district court Judge L. Felipe Restrepo has added the following documents:

The US District Court for the Eastern District of Tennessee has updated its Electronic Case Filing Rules and Procedures, increasing the maximum file size to 50 megabytes (MB). Previously, the maximum size allowed was 20 MB.

Seventh Circuit

Northern District of Illinois

Magistrate Judge Maria Valdez updated her Instructions for Settlement Conference. A copy of the previous version of the instructions is available here.

Ninth Circuit

Central District of California

Last week, the US District Court for the Central District of California began a pilot project for the electronic submission and filing of under-seal documents.
In light of the pilot project, several judges have updated their rules on filing documents under seal:
  • Judge Percy Anderson has amended his procedures, adding Procedure 15.
  • Judge Robert N. Block has amended his procedures, adding Procedure 18.
  • Judge Cormac J. Carney has posted instructions.
  • Judge Dale S. Fisher has posted instructions.
  • Judge Margaret M. Morrow has revised her instructions.
  • Judge James V. Selna has posted instructions.
  • Judge Josephine Staton Tucker has posted instructions.
  • Judge Otis D. Wright II has amended his procedures, adding Procedure XVI.
  • Magistrate Judge Alicia G. Rosenberg has amended her procedures to add Procedure 2, and has also posted instructions.
The following Central District of California judges made other changes to their rules and procedures:

Northern District of California

The US District Court for the Northern District of California has revised Local Rules 5-1 and 5-5 to reflect efforts to allow registered CM/ECF users to electronically file case initiating documents in civil cases. The court provided a redline of the rule changes, which is available here.
