Jackson Lewis: District of Columbia Enacts Ban-the-box Legislation Limiting Employers' Criminal Background Inquiries on Applicants | Practical Law

This Law Firm Publication by Jackson Lewis P.C. discusses the Fair Criminal Record Screening Amendment Act of 2014 (A20-0422), recently signed by District of Columbia Mayor Vincent C. Gray. Under the new law, an employer employing more than ten employees in the District of Columbia may not inquire into criminal conviction background on its employment application, make a criminal conviction inquiry or conduct a criminal background check until after it makes a conditional offer of employment. Further, an employer may only withdraw a conditional employment offer for a "legitimate business reason." The new law, which amends the Re-entry Facilitation Amendment Act of 2012, will become effective early October 2014, following Congressional review and publication in the District of Columbia Register.
