Jackson Lewis: Puerto Rico Supreme Court Scolds Employer for Interfering with Working Mother's Breastfeeding Rights | Practical Law

This Law Firm Publication by Jackson Lewis P.C. discusses Siaca v. Bahia Beach Resort & Golf Club, in which the Puerto Rico Supreme Court held that public and private employers must provide a private, safe, and hygienic (although not permanent) place for employees to exercise their breastfeeding rights. The court did not define "space," but rejected the spaces that the employer had provided to the mother in question (the dirty, non-private spaces did not comply with Law No. 427) and outlined what an employer must do to protect working mothers' rights. Violations of Law 427 will occur if an employee is forced to stop breastfeeding or her capacity to breastfeed is affected by her employer's negligent acts or omissions.
