The Court of Appeal has held that where an employee exercises his right of objection to his employment being transferred to the transferee under TUPE because of substantial change to his detriment in his working conditions, he has a right of action arising from such a constructive dismissal against the transferor even though the repudiatory breach was committed by the transferee.
